Damage, Liens and Indemnity

This is a clause that is contained in the Colorado Approved Contract to Buy and Sell Real Estate which primarily means the Buyer is entitled to purchase the home in the same condition as it was when they made the Offer.  If the furnace stops working while under contract, you would need to repair or replace the furnace to working condition. If a huge section of fencing was torn down due to any means, you would need repair or replace the fencing. 

On the other hand, if a Buyer brings anyone onto the property for any reason and there is any damage as a result, the Buyer would be liable for the repair whether the home closes or not.
